Individuals under 18 must have a parent or legal guardian enter into this Agreement on their behalf.

4. Services

E2G provides professional branding and marketing services for independent artists, including but not limited to:

  • Brand strategy

  • Artist positioning

  • Website design and development

  • Website maintenance

  • Email marketing setup

  • Fan funnel development

  • Content strategy

  • AI-powered marketing services

  • AI audience research

  • AI competitor analysis

  • Advertising management

  • Landing page development

  • Analytics implementation

  • Consulting

  • Digital marketing strategy

Services may change without prior notice.

5. Strategy Calls

Strategy calls are provided to discuss your goals and determine whether E2G is an appropriate fit.

A strategy call does not guarantee acceptance as a client.

6. Project Timeline

After all required information, assets, and payment have been received, E2G generally requires 5–7 business days to complete the initial setup and deliver the first version of your project.

This timeframe may vary depending on:

  • Client responsiveness

  • Scope changes

  • Third-party delays

  • Missing assets

  • Technical issues

  • Holidays or unforeseen events

Timeframes are estimates and are not guaranteed.

7. Client Responsibilities

Clients agree to provide all requested materials in a timely manner, including but not limited to:

  • Logos

  • Photos

  • Music links

  • Social media access

  • Domain information

  • Brand assets

  • Business information

  • Advertising account access (if applicable)

Delays caused by missing information may extend project timelines.

8. Revisions

Unless otherwise specified in writing:

  • Reasonable revisions are included during the initial project phase.

  • Requests that materially change the agreed scope may require additional fees.

  • Additional revisions beyond the included scope are billed at E2G's current hourly or project rate.

9. Pricing

Prices displayed on our website are subject to change at any time without notice.

Existing clients will continue under their agreed pricing unless otherwise stated in writing.

10. Payment Terms

Payment is due according to the selected package.

Setup fees must be paid before work begins.

Monthly subscription fees are billed in advance.

Failure to pay may result in suspension or termination of services.

11. No Refund Policy

ALL SALES ARE FINAL.

Due to the custom, digital, and service-based nature of our work:

  • No refunds will be issued for setup fees.

  • No refunds will be issued for monthly service fees already paid.

  • No refunds will be provided for partially completed work.

  • No refunds will be issued due to changes in personal circumstances, business decisions, financial hardship, or dissatisfaction after work has commenced.

By purchasing any service, you acknowledge and agree to this no-refund policy.

12. Subscription Services

Monthly services automatically continue until canceled.

Clients may cancel future recurring services by providing written notice before their next billing cycle.

Cancellation does not entitle the client to a refund for payments already processed.

Services remain active through the end of the current billing period.

13. Missed Payments

If payment fails:

  • Services may be paused.

  • Websites may be placed into maintenance mode or suspended if hosting is included.

  • Marketing campaigns may be paused.

  • Access to deliverables may be delayed until payment is received.

Repeated payment failures may result in permanent termination of services.

14. Chargebacks

Initiating a chargeback after services have begun may result in:

  • Immediate suspension of services.

  • Termination of all agreements.

  • Collection efforts for unpaid balances.

  • Recovery of legal fees and administrative costs where permitted by law.

Clients agree to contact E2G first to resolve billing concerns before initiating a payment dispute.

15. Advertising Services

E2G may manage advertising campaigns on platforms including but not limited to:

  • Meta

  • Instagram

  • Facebook

  • TikTok

  • Google

  • YouTube

Advertising budgets are separate from E2G service fees unless explicitly stated otherwise.

Clients are solely responsible for advertising spend.

16. Marketing Results

E2G provides professional marketing services but does not guarantee:

  • Increased followers

  • Increased streams

  • Viral content

  • Revenue growth

  • Record deals

  • Playlist placements

  • Sales

  • Media coverage

  • Sponsorships

  • Chart rankings

  • Search engine rankings

  • Return on advertising spend

  • Any specific business outcome

Marketing results depend on numerous factors beyond E2G's control.

17. AI Services

Some services utilize Artificial Intelligence.

Clients acknowledge that:

  • AI-generated content may require edits.

  • AI recommendations are advisory in nature.

  • Final approval of content rests with the client.

  • E2G is not responsible for decisions made solely based on AI-generated recommendations.

18. Third-Party Platforms

E2G is not responsible for changes, outages, suspensions, algorithm updates, or policy changes made by third-party platforms including:

  • Spotify

  • Apple Music

  • Meta

  • Instagram

  • Facebook

  • TikTok

  • YouTube

  • Google

  • Mailchimp

  • Calendly

  • Stripe

  • PayPal

  • Hosting providers

19. Intellectual Property

Clients retain ownership of materials they provide.

Upon full payment, clients receive ownership of final custom deliverables unless otherwise agreed.

E2G retains ownership of:

  • Internal systems

  • Workflows

  • Templates

  • AI prompts

  • Proprietary processes

  • Source materials not specifically transferred

20. Portfolio Rights

Unless otherwise agreed in writing, E2G may display completed work in portfolios, social media, presentations, case studies, and promotional materials.

Confidential information will not be disclosed.

21. Confidentiality

Both parties agree to keep confidential information private and use it only for purposes related to the services provided.

22. Website Hosting

If E2G provides hosting or ongoing maintenance:

  • Clients must maintain active payments.

  • Failure to pay may result in suspension of hosted services.

  • E2G is not responsible for third-party hosting outages.

23. Client Conduct

Clients agree not to:

  • Abuse staff.

  • Submit unlawful content.

  • Infringe copyrights.

  • Engage in fraudulent activity.

  • Use services for illegal purposes.

E2G reserves the right to terminate services for violations.

24. Limitation of Liability

To the maximum extent permitted by law, E2G shall not be liable for:

  • Lost profits

  • Lost revenue

  • Lost business opportunities

  • Data loss

  • Reputation damage

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Special damages

E2G's maximum liability shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

25. Indemnification

Clients agree to defend, indemnify, and hold harmless E2G, its owners, contractors, affiliates, and representatives from any claims, damages, liabilities, losses, expenses, or legal fees arising out of:

  • Client-provided content

  • Copyright infringement

  • Trademark disputes

  • Advertising claims

  • Client misuse of services

  • Violation of applicable laws

26. Force Majeure

E2G shall not be liable for delays or failures caused by events beyond reasonable control, including but not limited to:

  • Natural disasters

  • Internet outages

  • Power failures

  • Government actions

  • Labor disputes

  • Cyberattacks

  • Pandemics

  • Third-party service interruptions

27. Termination

E2G reserves the right to suspend or terminate services at any time for:

  • Non-payment

  • Fraud

  • Abuse

  • Illegal activity

  • Violation of these Terms

Termination does not relieve the client of payment obligations already incurred.

28. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles.

29. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

30. Entire Agreement

These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between E2G and the client regarding the use of the website and services.

31. Changes to These Terms

E2G may update these Terms & Conditions at any time.

Continued use of the website or services after updates constitutes acceptance of the revised Terms.
